1. Area of application
These terms and conditions apply to all deliveries made by SolarCosa as a result of received orders. No further agreements, either verbal or written, have been made. Should any provisions included herein become not legally effective and/or not practicable either wholly or in part, and/or lose their legal effectiveness and/or practicability at a later date, this shall not affect the validity of the remaining provisions
2. Prices
The prices indicated on the items include statutory value-added tax. All offers are non-binding and subject to confirmation. Errors excepted.
3. Shipping costs
We can ship to any address in Germany free of charge for orders of €100 or more. For orders less than this amount we charge €4.95 shipping and handling for each order. We deliver to Belgium, Denmark, England, Finland, France, Italy, Luxembourg, Monaco, the Netherlands, Austria, Poland, Scotland, Sweden, the Czech Republic and Wales, and for each order we charge €9.95 for freight costs. For shipment to Andorra, the Azores, Balearic Islands, Greece, Ireland, Canary Islands, Liechtenstein, Madeira, North Ireland, Portugal, Switzerland, Slovakia, Slovenia, Spain, Hungary and the Vatican we charge €12.95 for freight costs for each order. We deliver to Albania, Andorra, Bulgaria, Estonia, Faroe Islands, Georgia, Iceland, Israel, Yugoslavia (Serbia and Montenegro), Croatia, Latvia, Lithuania, Macedonia, Malta, Moldavia, Norway, Romania, Turkey, Ukraine, the United States of America, Belarus as well as to Cyprus, and for each order we charge €29.95 for transport costs.
4. Order confirmation
We confirm every order immediately by email. For large quantity orders we require your reconfirmation of our confirmation.
5. Method of shipping
Deliveries are generally carried out by United Parcel Service (UPS). In particular cases we commission other carriers.
6. Risk of transport
SolarCosa carries the risk of loss or damage to goods on transport before they are delivered to the buyer. The same applies to return consignments within the scope of right of cancellation (see §8).
7. Delivery time
In general we can deliver nationwide within 48 hours of receipt of your order, provided that all billing and delivery information has been submitted to us and that the goods are available. In case several deliveries are necessary due to bottlenecks in the delivery, SolarCosa will not charge you more for shipping than the amount that was originally quoted to you at the time you place your order.
8. Right of cancellation
You have the right to withdraw from your contract in writing (e.g. by letter, fax, email) within two weeks or by returning the goods without having to give any reasons, as far as you purchase the goods as a consumer, i.e. for a purpose, which cannot be regarded for commercial or self-employed use (orders by entrepreneurs). The stipulated period begins at the earliest upon receipt of the goods and written instructions for cancellation.

You must return goods at your cost if the goods delivered correspond to the purchase order and if the price of the goods to be returned does not exceed an amount of €40 or if you have not yet performed any contractually agreed quid pro quo or made any partial payment of a higher price for the goods at the time of cancellation. Otherwise you are not obliged to bear the cost of returning the goods.

9. Consequences of cancellation
In case of a valid cancellation both parties are bound to return the services received including incidental compensations for use (e.g. interest). If you are unable to return the service received in its entirety, only partially or perhaps in a deteriorated condition, you are obliged to compensate the appropriate value. This is not necessary if the deterioration of the goods is made solely on the basis of an examination as might have been possible for the customer in a shop. In addition, you can avoid having to replace the lost value by not treating the goods as your own property and by refraining from doing anything that will diminish their value. Items suited for package delivery are to be sent back in their original packaging at our risk.
10. Warranty
Should the delivered item clearly show material or manufacturing defects, to which transport damages also count, please submit your complaints to us or to the dispatcher. Legal rights to rectification, to removal of all material or manufacturer's defects arising within the legal warranty period or new delivery as well as - when legal requirements are present - right to a purchase price reduction or withdrawal from contract, right to demand damages, including replacement of damage instead of reimbursement of your futile expenditure are made valid at buyer's option. Warranty claims exist without prejudice to the legal requirements/rights.
For return delivery of guaranteed items, please use the attached return merchandise form we enclose with every consignment. Please give a brief description of the defects and let us know what we can do to solve the problem.
11. Method of payment
We require payment in advance of shipping. Payment can be made with credit card or cash on delivery. For payments in advance, we grant a 3% cash discount. We enclose a sales receipt with every consignment.
11.1. Pre-payment
Advance bank transfer is accepted but not in cheque form. Our order acknowledgment will include the total price less 3% cash discount, the order number and our bank account details. Please make sure you indicate in your payment the order number so that we can process your order quickly. Dispatch of goods follows after receipt of invoice amount.
11.2. Credit card payment
We accept Eurocard/Master Card, American Express, and Visa. In addition to your credit card number, the expiry date and the credit card company, we also require the credit card verification number (CVV). The CVV is a 3-digit number (Eurocard/Mastercard, Visa) or 4-digit number (American Express) on your credit card, which provides security enhancement against misuse of credit cards on the Internet. We debit the purchase price with confirmation of your order.
11.3. Cash on delivery
Payment is to be made to the dispatcher at your door. There is a COD charge of €6.95 within Germany. There are no additional collection charges on delivery. There is a standard COD charge of €13.95 for shipments outside Germany, and possibly additional collection charges by the deliverer.
If you do not accept a consignment on COD basis, you must pay for the cost resulting from the dispatch, the COD charges for orders on a COD basis.
12. Retention of title
The goods supplied to the customer remain the property of SolarCosa until the complete purchase price has been paid.
13. Data acquisition and storage
Our data security practice is in accord with the German Data Protection Act and the Electronic Telecommunication Services Data Protection Act. We protect your personal information with a secured SSL connection. All information entered when ordering e.g. your personal information (address, telephone number, etc.), the chosen method of payment and credit card and account information. SolarCosa only share personal information (without your consent) necessary for processing the order and for the settlement of the contract. You can get information from us anytime concerning your stored personal information or have your personal information erased.

14. Final clause
The general terms and conditions of sale are subject to the Law of the German Federal Republic.
